      <title>Understanding Who is Considered a Dependent for Medical Insurance Purposes</title>
      <description><![CDATA[The Federal definition of an eligible dependent child is a dependent child under the age of 26. You cannot exclude children who have group insurance available to them unless your plan is grandfathered, and to retain grandfathered status for a fully insured or self insured plan is almost impossible. The Federal Law also imposes special notice requirements which need to be delivered to all eligible employees and/or dependents. This notice must state when an employee will have the right to enroll a dependent child(ren) and the process to do so. <br /><br />Massachusetts state law’s definition of a dependent child differs from the Federal definition. However most Massachusetts medical insurance carriers amended their group medical plans issued in the state of Massachusetts to comply with the Federal definition of a dependent child. Therefore, the state of Massachusetts’ definition of a dependent child may not apply. <br /><br />In addition to the federal and mass state laws all plan sponsors should also take into consideration “Michelle’s Law” prior to terminating coverage on a dependent child. <br /><br />As with all contracts it is the plan sponsor’s responsibility to follow the terms of their own contracts.]]></description>
